These Terms & Conditions govern your access to and use of MyPracticeHelper.com and related services (the "Platform"). The Platform is operated by The Novita Group Pty Ltd ("Novita", "we", "us", or "our"), trading as My Practice Helper / MyPracticeHelper. By creating an account or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

1. Important Distinction: Software Vendor, Not a Healthcare Provider

MyPracticeHelper is NOT a Care Giver, Healthcare Provider, or Health Service Provider. We do not provide therapy, counselling, psychological, medical, or clinical advice. We act strictly as a technology software vendor supplying administrative practice-management tools.

  • All therapeutic and clinical services are delivered solely by the independent therapist or practice using the Platform.
  • The operating therapist or practice remains the sole legal controller of health records and the sole Health Service Provider in relation to client care.
  • MyPracticeHelper does not supervise, verify, or guarantee any therapist's qualifications, licensing, or clinical decisions.

2. Zero-Access / Safeguarded Architecture

Clinical progress notes, patient records, and session data are safeguarded exclusively to the operating therapist's account under our zero-access / safeguarded architecture:

  • MyPracticeHelper employees, support staff, and automated system processes do not possess access to unencrypted clinical records.
  • Because MPH does not have technical access to unencrypted client health files, legal requests, subpoenas, or patient-record demands must be directed to the treating therapist as the legal controller of the health record.
  • MPH never acts as a health-record controller for clinical notes stored under therapist-exclusive access controls.

3. Eligibility & Accounts

You must be at least 18 years old and legally able to enter a binding contract under Australian law to use the Platform. You are responsible for:

  • Providing accurate registration and practice information.
  • Maintaining the confidentiality of your login credentials.
  • All activity occurring under your account.
  • Notifying us promptly at help@mypracticehelper.com if you suspect unauthorised access.

4. Therapist & Practice Responsibilities

Therapists and practices using MyPracticeHelper are solely responsible for:

  • Compliance with all applicable professional, licensing, privacy, and legal requirements in their jurisdiction (including, where applicable, the Australian Privacy Act 1988 (Cth) and Australian Privacy Principles).
  • The accuracy of information supplied to clients.
  • Obtaining any required consents for collecting and storing client information on the Platform.
  • Delivery of therapy or wellness services to their clients. The Platform is an administrative tool only and does not create a clinical relationship between MPH and any client.

5. Clients Using the Platform

Where clients interact with the Platform (for example via booking or video links):

  • MyPracticeHelper is not a healthcare provider.
  • All therapy or wellness services are delivered directly by the therapist, not by MPH.
  • The Platform may send reminders, notifications, or messages on behalf of therapists for administrative purposes only.
  • The Platform must not be used for emergencies, crisis situations, or time-sensitive clinical matters. Seek urgent help from appropriate emergency or crisis services.

6. Billing, Subscriptions & Reseller Relationship

My Practice Helper / MyPracticeHelper is a product of The Novita Group Pty Ltd, an Australian company. References in these Terms to MyPracticeHelper, MPH, or My Practice Helper mean The Novita Group Pty Ltd in relation to the Platform, except where Paddle acts as Merchant of Record for checkout as described below.

Merchant of Record

Our checkout process is operated by our order process partner and Merchant of Record, Paddle.com Market Ltd ("Paddle"). When you purchase a subscription to My Practice Helper, you buy the product through Paddle, who acts as the reseller and handles order processing, tax collection, and invoicing on behalf of The Novita Group Pty Ltd.

Buyer Terms

By completing a transaction via Paddle, you agree to be bound by Paddle's Checkout Buyer Terms in addition to these Terms of Service.

Taxes & Pricing

All stated subscription fees are tax-exclusive unless explicitly noted otherwise. Applicable sales tax, GST, or VAT will be calculated dynamically and added at checkout by Paddle based on your location and business registration status.

Refunds & Cancellations

Refunds and cancellations are processed in accordance with our Refund & Cancellation Policy and Paddle's global refund standards. Initial subscription purchases are eligible for a 14-day statutory money-back guarantee.

Paid plans, trials, and optional add-ons (including multi-therapist or receptionist team features, where offered) are described on the Platform at the time of purchase. Trial access may be limited by duration, client volume, or feature scope as disclosed during signup. Optional team / multi-user features may attract additional charges when enabled. We do not store full card numbers on our servers.

7. Acceptable Use

You agree not to:

  • Use the Platform for unlawful, harmful, or abusive purposes.
  • Upload malware or attempt to disrupt security or availability.
  • Access accounts or data you are not authorised to access.
  • Misrepresent MyPracticeHelper as a healthcare provider or as delivering clinical care.
  • Reverse-engineer, copy, or resell the Platform except as permitted by law.

8. Intellectual Property

All software, design, branding, and content on the Platform (other than content you upload) are owned by The Novita Group Pty Ltd (trading as MyPracticeHelper) or its licensors. You retain ownership of your practice content and client records subject to these Terms and our Privacy Policy.

9. Privacy

Personal information is handled as described in our Privacy Policy, which forms part of these Terms. That policy explains our compliance approach under the GDPR (where applicable) and the Australian Privacy Act 1988 (Cth) / Australian Privacy Principles (APPs), and the distinction between MPH as Data Controller (account/billing) and Data Processor (client/clinical infrastructure on behalf of the therapist).

10. Service Availability

We aim to keep the Platform reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other applicable Australian law that cannot be excluded by contract.

Where our liability cannot be excluded but can be limited, and it is fair and reasonable to do so, our liability is limited to resupplying the services or paying the cost of resupplying the services.

12. Limitation of Liability

To the maximum extent permitted by Australian law:

  • MyPracticeHelper is not liable for clinical outcomes, advice, omissions, or services of therapists using the Platform.
  • We are not liable for loss arising from your use of the Platform for emergency or crisis communications.
  • We are not liable for unauthorised access to data caused by compromised credentials or devices under your control.
  • Except for liability that cannot be limited under Australian Consumer Law, our aggregate liability arising from the Platform is limited to the fees you paid to MPH for the services in the 12 months before the claim.

13. Indemnity

You agree to indemnify and hold harmless The Novita Group Pty Ltd (trading as MyPracticeHelper) from claims, damages, and expenses arising from your misuse of the Platform, your breach of these Terms, or your provision of therapy or other professional services to clients.

14. Suspension & Termination

We may suspend or terminate accounts that violate these Terms, create security risk, or misuse the service. You may stop using the Platform at any time. Provisions that by nature should survive (including intellectual property, liability limits, indemnity, and governing law) continue after termination.

15. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will change when we do. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms, except where Australian law requires a different process.

16. Governing Law & Disputes

These Terms are governed by the laws of Western Australia, Australia, and the Commonwealth of Australia as applicable. Subject to any non-excludable rights, the courts of Western Australia have non-exclusive jurisdiction.

If a dispute arises, contact us first so we can attempt to resolve it in good faith before formal proceedings.
